Terms & Conditions for Florida 2022

By making a reservation, you are entering into a rental contract with "Aunger Rentals LLC DBA, Aunger Vacation Homes", and therefore agree to and are bound by Aunger Vacation Homes Terms and Conditions. Known terms: "The Property" means the home, house, or property that has been booked via the reservation. "Guest or Guests" is the person or persons that have made the booking or reservation.
1. Reservation Acceptance & Payment
- If the reservation is made more than 45 days before the scheduled arrival, a deposit is required.
- The final payment is due 45 days before the arrival date. The final payment will be billed to the credit card on file unless other payment arrangements have been made. Payment of the rental deposit to Aunger Vacation Homes signifies full acceptance of these terms and conditions of rental.
2. Minimum Age of Guest Making the Reservation
- The Guest making the reservation must be 25 years of age or older, the holder of a major credit card, and must reside in or occupy The Property for the entire term of the reservation.
- Persons or minors under the age of 25 years old must not be left in The Property on their own. A responsible person identified in the rental reservation over 25 years of age should always be present at The Property to be responsible for persons under the age of 25 years old. {BXCERTIFYOVER25YEARS}
- Guests cannot rent The Property on behalf of other guests or under-25-year-old guests; there are no exceptions.
3. Falsified Reservations
- Any reservation obtained under false pretense will be subject to forfeiture of any payment, deposit, and/or rental money, and the party will not be permitted to arrive/check in. If already checked in, the party will forfeit the reservation and must immediately vacate The Property.
4. Documents Required to Validate Reservation
To validate the reservation, the Guest making the reservation must send the following by email:
- Signed Rental Agreement
- A legible copy of a driver’s license
Both documents must be of the Guest making the reservation.
5. "Last Minute" Reservations
The following will be required for reservations made within 30 days of arrival. These precautions may also be requested for any reservation regardless of the processed date.
- The Guest making the reservation must be 25 years of age or older and must occupy The Property for the entire term of the reservation.
- The reservation must be in the same name as the name on the credit or debit card used for payment.
- The credit or debit card used is required to be shown at check-in.
- A valid driver’s license or passport is required.
- A billing statement to the same address associated with the credit card must be presented.
All names on documents must match the Lead Guest on the reservation: payment card name, photo ID, and billing statement.
6. Condition of The Property
Aunger Vacation Homes endeavors to provide an accurate description of The Property and its condition. Guests understand it is reserved "sight unseen." Our cleaning staff will clean before occupancy. All electrical, plumbing, and appliances should be in working order. Failures of extra amenities (TVs, cable, games, Internet/Wi‑Fi) are not a basis for refund. We will make every effort to repair but do not guarantee repairs during occupancy. If the home has not been cleaned to normal standards upon arrival, notify Aunger Vacation Homes immediately. Tradespeople may not be available over holidays/weekends. No rental money will be refunded due to the condition of the house. The Guest agrees to hold Aunger Vacation Homes harmless from any liability for the condition of the house.
7. Arrival Check-in / Departure Check-out Times
- Check-in is after {BCHECKINTIME} and check-out is before {BCHECKOUTTIME}.
- No early check-ins or late check-outs without prior consent. These may be requested and are subject to no adjacent reservations. Tentatively booked and confirmed only within 72 hours of arrival; Guest must contact Aunger Vacation Homes within 72 hours of arrival to confirm availability.
- If a Guest fails to depart by 10:00 AM without a late check-out arranged and this prevents preparation for the next Guest, the departing Guest agrees to pay damages/costs, including relocation of the incoming Guest.
- Failure to vacate by 10:00 AM: a late fee of 25% of the nightly rate will be charged up to 12 PM and 50% by 4 PM plus taxes after 20 minutes late. No refunds for early departures or late arrivals.
8. Check-in Instructions
- The Property has an electronic smart lock. The door code will be sent upon receipt of final payment and confirmation of receiving these terms, and a welcome guide. Access codes are generated and released four hours prior to arrival.
- Check-in is fully electronic. Go directly to The Property with the codes provided. No in-person check-in (unless to receive a security deposit). All steps must be completed online prior to arrival.
9. Arrival Inspection and Pre-Existing Damage Report
- Notify Aunger Vacation Homes within 12 hours of arrival of any existing damage or notable conditions.
- The Guest is responsible for the cost of any damages to The Property, décor, or contents during the stay, including moving items to another property, breakages, and excessive cleaning. SMOKING AND PETS ARE NOT PERMITTED ON THE PROPERTY whatsoever. 10. Accidental Damage Protection (ADP)
- The accidental damage protection fee is non-refundable and covers reported accidental or inadvertent damages reported in writing within 24 hours of the damage.
- Coverage becomes void upon departure; unreported damage found after departure is the Guest’s responsibility.
- Coverage value is up to $3,000 for The Property. Intentional damage, theft, or gross negligence is not covered. The plan is administered by Aunger Vacation Homes and is not an insurance policy.
11. Security Deposits
- A security deposit may be held for loss or damage. It may be required based on guest count relative to property size, including after the initial reservation.
- Fully refundable within 14 days after satisfactory inspection. Paid by credit card with the final balance. Failure to pay a requested deposit will lead to cancellation.
12. Additional Damages
- Report any new issue during the stay; Aunger Vacation Homes will make efforts to rectify.
- If a reported problem remains unresolved, notify in writing within seven days of vacating. No action can be taken for complaints received after this period.
- Do not set A/C below 72°F (20°C). Lower settings may freeze the unit; Guest will be responsible for technician call-out charges. Keep windows and doors closed.
13. Cleaning
- A one-time departure cleaning fee is included.
- Cleaning occurs after departure and does not include daily dishwashing or routine self-catering tasks. Additional cleaning required will be charged. Keep house, furniture, and furnishings clean and in good order.
- Cleaning fees do not include excessive trash removal or remediation of stains/damages to carpet, linens, or furnishings.
- Trash/recycling must be bagged and placed in proper receptacles per provided community procedures.
- For stays over 14 nights, a mid-stay cleaning is required at Guest expense and must be scheduled with access provided.
14. Property Use: General Terms & Conditions
- No candles inside or outside, including covered areas and garage.
- Use premises exclusively as a private residence and in compliance with local ordinances and fire regulations. Unlawful use may void the agreement.
- Do not move furniture. Charges apply for any resulting damage.
- No daily maid service unless purchased.
- No outside cooking appliances or large additional appliances may be brought to The Property. Trailers (including freezer trailers) are not permitted by HOA rules.
- Smart Home technology may be installed (e.g., remotely monitored thermostats, door locks, pool heater controls, mobile device sensors, and noise-measuring devices). Noise devices measure decibel levels only and do not record voices or biometric data.
- Do not use vacant lots for any purpose, including parking. HOA may enforce removal.
- RVs, commercial vehicles, and buses are prohibited per community rules. Park on driveway where possible. No overnight street parking where prohibited. Never park on grass; damage to irrigation is Guest’s responsibility.
- Occupancy may not exceed posted maximums (excludes children under three). Only persons listed in this Agreement may stay.
- Stay is short-term vacation rental, not a permanent residence or tenancy.
- Reservation is confirmed only for the number of guests listed. Adding guests without consent may lead to cancellation.
- No illegal or commercial use, including subletting. Any changes to named guests must be reported in writing. Home is self-catering; starter supplies are provided, and Guest must purchase additional as needed.
- Rental period begins and ends on the dates in the Rental Agreement. Violations render the reservation void with forfeiture of monies.
- No parties, events, or social/group gatherings. Unauthorized events or exceeding authorized guests will result in removal without refund and/or cancellation.
- No drug use in or near The Property. Illegal activity terminates occupancy without refund.
- Quiet time is 10:00 PM EST onwards. Violations may result in immediate termination without refund.
- For neighboring property disturbances, contact neighborhood security or the county sheriff’s non-emergency line.
- Abide by all parking rules/laws and posted signage. Guests park at their own risk.
- No assignment or subletting. No changing/adding locks or duplicating keys.
- No amateur/professional video production without prior written consent.
- No business may be registered to or operated from The Property by guests.
- Locked storage areas (closets, safes, garages) used by management are not for guest access.
- No RV campers, enclosed trailers, or tents on or near The Property as per community guidelines.
- Guests must agree to and abide by all community and HOA rules.
- All property descriptions are made in good faith; no liability for errors/omissions.
- Aunger Vacation Homes and/or representatives may enter The Property as reasonably necessary (protection/inspection, emergency, maintenance/repairs, services, showings) with notice as deemed appropriate.
- No liability for construction/refurbishment noise or dust, including neighboring properties not under our control.
- Minor neighboring maintenance will not require alternative accommodation or compensation.
- No glitter, party spray string, temporary color dyes, or similar items in the house. Extra cleaning/damage charges will apply.
15. Weddings, Corporate Events, Groups or Gatherings
Parties, weddings, corporate events, or any group gatherings are strictly prohibited unless prior written permission has been granted. Violation may result in:
- Immediate eviction without refund; and/or
- Invoicing for additional charges equivalent to approved event fees, payable within 14 days of receipt.
16. No Smoking
The Property is strictly non-smoking in, around, or near The Property. This includes tobacco, marijuana, vape pens, cartridges containing liquid nicotine, hookahs, cigars, or any lighted/inhaled material. Damage caused by smoking is the responsibility of the Guest. Failure to comply will result in removal without refund and a minimum $1000.00 fine, plus deep-clean costs. {BXNOCONTSMOKINGINITAL}
17. No Illegal Drugs
No illegal drugs on The Property. Possession or use is grounds for immediate eviction and forfeiture of payment. Guests waive rights to recourse against Aunger Vacation Homes for enforcing this clause.
18. Firearms
Only legally owned and permitted firearms are allowed according to state and local laws. Firearms are at Guest’s own risk.
19. Pets
ABSOLUTELY NO PETS ARE ALLOWED. Violation will result in removal without refund and a minimum $500 plus taxes per pet, plus any additional cleaning/repair charges. The rental contract will be terminated. {BXNOPETSALLOWEDCONT}
20. Service Animals
Service animals certified to ADA requirements are welcome. It is helpful to notify Aunger Vacation Homes in advance. The handler is responsible for sanitary conditions and any damages.
21. Fireworks
Fireworks and hazardous materials shall not be used in or around The Property. Exploding and/or flying fireworks (shells, mortars, multiple tube devices, Roman candles, rockets, firecrackers) are illegal in Florida.
22. Utility or Service Outages
Occasional outages beyond our control may occur. Please report outages as they occur. No refunds or compensation will be given for outages beyond our control.
23. Pool / Spa / Hot Tub & General Safety
- Guests are responsible for their personal safety and that of their companions.
- Use of the rental Property and pool is entirely at the Guest’s risk. No diving, horseplay, or running around the pool. Non-swimmers/children must have adequate adult supervision by a strong swimmer.
- Guests under 18 must always be accompanied at pools.
- Doors with direct pool access may be alarmed. Tampering is a criminal offense per Chapter 515.33 of the Residential Swimming Pool Safety Act. Minimum $75 per alarm for repair/replacement if tampered with. If a removable pool safety fence is present and removed, Guest assumes full responsibility for pool/spa/hot tub use.
- Safety fence (if installed) must always be used.
- Games, toys, and baby equipment are used at Guest’s own risk. Supervise children at all times.
- Children must not use adult-intended features (gyms, saunas, billiard tables, etc.).
- A complimentary outdoor barbecue grill is provided at Guest’s own risk. Guest is responsible for any damage, cleaning, and propane replenishment. Minimum $50 cleaning charge if professional cleaning is required.
- For life-threatening emergencies, call 9-1-1 immediately before contacting Aunger Vacation Homes.
- Pool/spa/hot tub heat is not included unless stated. It may be added for a daily fee.
- When purchased, pool temperature targets approximately 80–84°F. Heaters are on timers and may cool overnight. Cold fronts may prevent maintaining higher temperatures; electric heat pumps are ineffective below 55°F. No refunds for cold-weather limitations.
24. Allergens
- Properties cannot be guaranteed peanut-free or allergen-free. Prior guests may have brought allergens (peanuts, perfumes, lotions, cleaning solutions, etc.).
- Guests may not bring pesticides, bleach, sanitizers, or air fragrances into The Property.
25. Wildlife and Insects
- Florida wildlife may pose danger; use caution outdoors. Never feed or approach wildlife. Take photos only from a safe distance. Examples include alligators, snakes, raccoons, foxes, and sandhill cranes. Feeding is illegal (see Florida statutes).
- Preventative efforts cannot guarantee the absence of wildlife, bugs, insects, or pests. Encounters do not create liability.
- If pests are suspected, contact Aunger Vacation Homes for a third‑party inspection/treatment if necessary.
26. Localized Construction
Construction or utility work may occur without our knowledge or control. We are not responsible for actions of other owners, HOAs, or utilities.
27. Personal Items Left Behind – Lost and Found
- Aunger Vacation Homes is not responsible for lost items.
- If found, Guest will be advised and given contact details of a local shipping service. Guest is responsible for all collection/shipment/delivery costs.
- Unclaimed items are kept no more than 7 days from departure and may then be donated or disposed of. Valid ID is required for pickup, or written authorization for third‑party pickup.
28. Basis of Rental
- Each Property includes a fully equipped kitchen and laundry, plus linens and towels.
- Properties are self‑catering. Complimentary starter kits (e.g., shampoo, conditioner, soap, toilet paper, trash bags) are provided; Guests must replenish as needed.
Failure to comply with any terms herein may, at the sole discretion of Aunger Vacation Homes, result in removal from The Property without refund.
29. Additional Charges
All normal utilities, local/long‑distance calls within the U.S. and Canada, basic cable, and Wi‑Fi are included. Additional fees apply for:
- Phone charges beyond included services (e.g., international calls, premium numbers).
- The Guest is responsible for the full amount of the reservation/booking including optional services and fees; no chargebacks are honored.
- No credit/debit card chargebacks are allowed; Guest agrees to pay all reservation/booking fees and costs.
- Pay‑per‑view or streaming charges ordered during the stay.
- Excess linens used.
- Fines or summons imposed by county or state due to guest actions.
- Fines imposed by the HOA due to guest actions.
- Any damage to The Property or contents.
- Excessive electricity or water usage.
- Extra‑person charges for guests over standard occupancy (up to legal maximum) or over the number on the reservation, whichever is greater.
30. Security & Security Cameras
- In a security emergency, call 911. Keep all windows and doors closed and locked. Aunger Vacation Homes is not responsible for stolen or damaged personal items. Properly secure The Property when leaving.
- In the event of a robbery, Aunger Vacation Homes is not responsible for stolen or damaged personal belongings.
- Protective security cameras cover exterior areas and the garage, and a video/audible doorbell may be present. No cameras are inside living areas such as bedrooms or living rooms.
31. Internet Access
Complimentary internet access is provided as a courtesy. Service is not under our control; no refunds for interruptions. We will attempt troubleshooting and notify the provider if needed. Access details are in the Welcome Guide.
32. Optional Travel Insurance
- Travel insurance is available through third‑party providers; costs and coverage vary by provider.
- Guests are responsible for arranging appropriate comprehensive travel insurance (medical, accidents, repatriation, cancellation/curtailment, etc.).
- We highly recommend purchasing travel/trip insurance at booking or at least 45 days prior to arrival. {BXTRAVELINSURANCE}
33. Hurricane Policy
- No refunds or rescheduling due to hurricane activity. Guests concerned about interruption or cancellation are strongly encouraged to purchase optional trip insurance (peak season August–October).
- During hurricane watch/warning, we may prepare The Property (occupied or not) for safety, including moving outdoor furniture/decor indoors, with prior communication where possible.
34. Force Majeure
- We will not be liable for failure or delay to perform obligations caused by events beyond our control (e.g., flight issues, closures, weather, disputes, civil commotion, terrorism, war, fire, storm, flood, earthquake, epidemic, natural disasters, telecom failures).
- If The Property becomes unavailable due to such events (e.g., destruction, leaks, fire), we will attempt to arrange a comparable property or refund all monies paid if not possible or not acceptable. If accepted, Guest agrees to relocate back to the original Property when available. No responsibility for other associated costs.
- We will notify Guests as soon as reasonably possible if affected by Force Majeure.
35. Cancellation Policy
All cancellations must be received in writing and are subject to the following penalty percentages of the total rental fee unless stated otherwise in the booking terms. Cancellations via credit card will have the credit card fee deducted from any refund.

- The Guest is reserving a specific property for specific dates. Changing dates or property constitutes a cancellation and the cancellation policy applies.
- If the length of stay is reduced (at our discretion), the cancellation policy applies to canceled nights. Minimum night requirements must still be met.
- Non‑payment of the balance by the due date results in loss of all monies. All cancellations must be confirmed in writing.
- We reserve the right to cancel any reservation due to error, omission, or unforeseen circumstances (verbal, written, or website errors affecting price, availability, or property type).
- These terms apply to any rental property booked through Aunger Vacation Homes, including if the property must be changed for any reason.
- All descriptions are made in good faith; no liability for errors or omissions. Consider optional Travel Insurance.
36. No Show Policy
Failure to appear at the scheduled check-in time constitutes noncompliance; access will not be allowed and no refund will be provided.
37. Complaints
- Report issues immediately during the stay so action can be taken. If unresolved, notify us in writing within 7 days of the end of your stay. Failure to do so affects our ability to investigate and consider the complaint. We aim to resolve complaints within 2 months of receipt.
38. Legal Terms & Limitation of Liability
- Entirety: This is the entire agreement, superseding all prior negotiations, agreements, and implied terms. Headings are for convenience only. Interpretation shall not be construed in favor of the non‑drafting party.
- Modification: Only Aunger Vacation Homes may modify this Agreement in writing. Assignment: Any attempted assignment, delegation, or sublease is invalid. Severability: Invalid provisions shall be construed to permit enforcement; otherwise, treated as if never existing.
- Warranties: None unless expressly stated. Discretion: Aunger Vacation Homes has sole discretion concerning breach/remedy determinations, subject to good faith and customary market practices. Reliance: Guest has not relied on prior representations and waives related claims. Performance: Excused when impracticable due to contingencies.
- Waiver: No breach is waived without express written consent.
- Remedies: Exclusive remedy is limited to actual financial losses and reasonable attorneys’ fees/costs as governed herein. If we employ an attorney due to Guest’s violation, Guest is responsible for all costs and reasonable attorneys’ fees. Jury trial is waived. Regardless of the failure of the exclusive remedy, we are not liable for consequential damages.
- Liquidated Damages: Agreed as non‑punitive and difficult to forecast.
- Chargebacks: Guest waives rights to dispute a credit/debit charge, request/demand a chargeback, or dispute that adequate descriptions and grievance instructions were provided. {BXCERTIFYOVER25YEARS}
- Hold Harmless & Defend: Guest holds harmless and defends Aunger Vacation Homes and its agents against third‑party complaints and indemnifies for defense costs and settlements, including claims by members of Guest’s party and invitees/licensees.
- Third‑Party Beneficiaries: None; any benefits are incidental. Conflict of Terms: This Agreement controls over conflicting terms elsewhere.
- Data Usage: Guest consents to the use of Guest data subject to governing law.
- Arbitration: Any controversy or claim connected to this contract (including credit card disputes and civil litigation) shall be settled by arbitration administered by the American Arbitration Association with one arbitrator in Osceola County, FL. Judgment may be entered in any court with jurisdiction.
- Litigation Terms: For matters not subject to arbitration, the Ninth Judicial Circuit of Florida (or appropriate U.S. District Court) shall be the exclusive forum; Florida law applies. Jury trial is waived. The prevailing party is entitled to reasonable attorneys’ fees and costs, including for defending chargebacks and related complaints.
- No liability for equipment/service failures; notify within one working day for rectification attempts.
- No liability for lost/stolen personal property; report to authorities first, then notify Aunger Vacation Homes.
- No liability for personal loss/injury during the rental period or for restricted/no access to resort amenities.
- We reserve the right to cancel the reservation and return all payments without interest or compensation. For major changes, we will inform as soon as possible; if not accepted, we will cancel and return payments without interest or compensation.
- No responsibility for accidents or illness on The Property.
- No liability for acts of violence, nature, fire, flood, war, civil disobedience, riot, or other force majeure.
- No liability for failures of public supplies (water, electricity, gas), telecoms, or actions of persons/authorities outside our control, including A/C, telephone, internet, or pool heater/appliance breakdowns. Urgent steps will be taken to arrange service.
- No liability for loss/damage/alteration caused by events beyond our control (e.g., war, terrorism, civil commotion, flight issues, closures, weather, fire, flood, industrial dispute). No credit for shortened stays due to late arrival or early departure, or for weather cancellations.
- Disputes shall be resolved exclusively via binding arbitration according to AAA rules for commercial disputes in Osceola County, Florida, applying Florida law. Each party pays its own attorney fees/costs. {BXCERTIFYOVER25YEARS}
39. Passport and/or Visa Requirements (if applicable)
All guests, if applicable, must possess valid identification, passports, and any required visas. Foreign citizens require a full passport valid for at least 6 months beyond the rental departure date.
40. Package Delivery or Mail Service
Aunger Vacation Homes is not responsible for any mail or packages sent to The Property.
41. Disclaimer
- Guests are responsible for exercising care on any wet surfaces. We are not responsible for injuries from slips on tile, pavement, sidewalks, or other surfaces.
- We are not responsible for injury, loss, or damage due to weather, Acts of God, equipment failure, or failure to take adequate precautions, including around wet areas.
- Website information (descriptions, amenities, photos, data, etc.) is provided in good faith; no liability for errors or omissions.
- Under no circumstances shall Guests or their guests hold Aunger Vacation Homes responsible for damages or claims resulting from their stay.
42. Firearms and Dangerous Projectiles
Firearms and dangerous projectiles are not allowed without prior approval. Discharge of firearms, air rifles/pistols, CO2 guns, bows and arrows, slingshots, or any hazardous projectile within the communities or on property is prohibited.
Reminders
- Strictly no pets.
- No smoking on any part of The Property area.
- No parties or gatherings.
- Only guests listed on this agreement are allowed.
- No additional guests/visitors without prior consent; no day visitors or parties without written consent.
